InterActive Terms and Conditions
1.
Payment is due 15 days after date of invoice.
Accounts are in default if payment is not received within 15
days after date of invoice. If
your check is returned to us unpaid you are immediately in default and
subject to returned check charge of $25.00 from us.
Accounts unpaid 15 days after date of invoice will have their
service interrupted. Such
interruptions may require an additional installation charge to have
account placed back into service. InterActive requires a 30 day
cancellation notice.

Processing of your order begins when your deposit is received.
Service is invoiced monthly if paying by credit card, or
quarterly if paying by check, cash, or money order due in advance.
InterActive Network Systems, Inc. reserves the right to change
the rates and otherwise modify these Terms and Conditions by notifying
you 60 days in advance of the effective date of the change.

All accounts are for end use only, no resale of access is
permitted without the expressed written permission of InterActive
Network Systems, Inc..

InterActive reserves the right to cancel an account at any
time, at our discretion. Refunds
on the unused balances will be forwarded within 15 days after said
account is terminated.

These Terms and Conditions supersede all previous
representations, understandings or agreements and shall prevail
notwithstanding any variance with terms and conditions of any order
submitted. Use of
InterActive Network Systems, Inc. constitutes acceptance of these
Terms and Conditions.
Rules
- Personal and standard commercial accounts are single login use only.
- No simultaneous logins are permitted
- Personal accounts are for the use by the purchaser of the account and
their immediate family. Do not give out your account information. The purchaser of the
account will be held responsible for any infractions of the rules.
- The running of security checking programs is not permitted, whether run
against this or other sites. This includes but is not limited to programs such as crack,
SATAN, COPS, port scanners, etc.
- Attempting to read other users mail, or reading and writing system files
is not permitted. All such attempts are logged.
- Running background processes (such as 'bots) are not permitted.
- When logging into IRC sites from your
JerseyNet/PhilaNet account you must follow
the rules of each site. Attacking IRC servers or otherwise getting
JerseyNet/PhilaNet banned in
any way from these servers will result in immediate termination of your account.
- Running a process or program for the sole purpose of keeping a connection
that would otherwise disconnect due to time-out is not permitted.
- Accounts are "interactive unlimited attended use" meaning that
as long as you are using your account from a computer where you are in attendance, then
you may use your account for as many hours as you would like.
- You may not leave a connection active, nor run software for the purpose
of keeping a connection active when you are not directly operating your computer as part
of your using the Internet.
- Cross posting to more than 10 newsgroups or inappropriately posting to
newsgroups ("spamming") is not permitted.
- Likewise unsolicited mailing (spamming) is not permitted. See the
attached Acceptable Use Policy.
- Proper "netiquette" must be observed at all times.
InterActive Network Systems, Inc. Acceptable Use
Policy
InterActive Network Systems, Inc. exercises no control
whatsoever over the content of the information passing through InterActive Network
Systems, Inc.. InterActive Network Systems, Inc. makes no warranties of any kind, whether
expressed or implied, for the service it is providing. InterActive Network Systems, Inc.
also disclaims any warranty of merchantability or fitness for a particular purpose.
InterActive Network Systems, Inc. will not be responsible for any damage you suffer. This
includes loss of data resulting from delays, nondeliveries, misdeliveries, or service
interruptions caused by its own negligence or your errors or omissions. Use of any
information obtained via InterActive Network Systems, Inc. is at your own risk.
InterActive Network Systems, Inc. specifically denies any responsibility for the accuracy
or quality of information obtained through its services.
InterActive Network Systems, Inc. may only be used for lawful purposes. Transmissions
of any material in violation of any US or state regulation is prohibited. This includes,
but it not limited to: copyrighted material, material legally judged to be threatening or
obscene, or material protected by trade secret. You agree to indemnify and hold harmless
InterActive Network Systems, Inc. from any claims resulting from your use of the service
which damages you or another party.
Any access to other networks connected to InterActive Network Systems, Inc. must comply
with the rules appropriate for that other network. Use of InterActive Network Systems,
Inc. itself may be for any lawful purpose. Use of InterActive Network Systems, Inc. for
lawful commercial purposes is both permitted and encouraged.
InterActive Network Systems, Inc. reserves the right to block
traffic from various sites on the internet from time to time as necessary
to maintain the reliable operation of it's servers and
infrastructure. This includes but is not limited to email, web
traffic, and ftp traffic. Likewise spam attacks from other
domains falls into this category and be considered a reason to block
traffic from that domain or address space.
Customer is responsible for any telephone charges that they incur,
InterActive Network Systems, Inc. cannot be held responsible for
customer's phone bill.
Customer agrees to comply with the rules, regulations and
policies applicable to any network, server, computer database, web site, newsgroup or ISP
that you access through InterActive Network Systems, Inc. services. Any violation of such
rules, regulations and policies may serve as cause for InterActive Network Systems, Inc.
to suspend or terminate your service.
- Customer agrees that an infraction of any of the below is considered a
material breach of its Agreement for Internet Services with InterActive Network Systems,
Inc., and further, that such infraction(s) may result in immediate termination of said
Agreement.
- Customers may not send unsolicited bulk mail messages ("junk mail" or
"spam") to any person who does not wish to receive it. If a recipient asks to stop receiving email the customer must
not send that person any further email.
- Customer agrees that InterActive Network Systems, Inc. reserves the right, with or
without notice, to suspend or terminate the service provided to you under this Addendum
upon the first or subsequent occurrence of any of the following
events.
- Customer agrees to pay liquidates damages in the amount of $1500
for each occurrence of a violation of our AUP with regard to the
sending of unsolicited email and also agrees to pay liquidated
damages of $250 per hour for each our InterActive’s personnel must
spend as a result of the sending of unsolicited email..
The service is used in a manner which constitutes violation of any tariff, regulation,
treaty or law (including, without limitation, copyright, privacy, criminal and
international law);
The service is used in a manner which is intended to abuse or to violate the privacy or
property rights of others;
The service is used to attempt to break security, or in fact, to break security of any
computer network, or to access an account which does not belong to Customer;
Customer agrees to immediately notify InterActive Network Systems, Inc. of any
unauthorized use of your account, and/or any breach, or attempted breach, of security
known to you;
Customer agrees that posting commercial messages to a USENET group requires that
commercial postings have been approved by the specific USENET group in its charter;
Forging electronic mail headers (addresses), or any other method used to disguise
Customers identity, is strictly prohibited;
Mail-bombing, that is sending mass amounts of e-mail to one recipient or system, with
the intent to render said system dysfunctional;
Non-authorized relays through any third party systems is strictly prohibited;
Syn flood attacks, that is to overburden a recipient computer system by sending a high
volume of spurious data which effectively impedes functionality, or totally disables
recipient system(s), and any other methods of denial of service, are strictly prohibited;
Customer agrees that its customers must be bound to these same restrictions, and that
such violation(s) by its customers is deemed to be a material breach by Customer.
INS/JerseyNet/PhilaNet management may occasionally send email with
information specific to the services provided by INS/JerseyNet/PhilaNet.
